Two rates, and which one applies to you

Stamp duty on a Kenyan property transfer depends on where the property is:

On a substantial purchase that difference is large, so establish the classification early rather than assuming — it is determined by the property's location relative to municipal boundaries, and a property that feels rural may not be classified that way.

Duty is generally assessed on the higher of the purchase price or the government valuer's assessment, so an artificially low declared price does not reduce it and can create problems of its own.

Stamp duty is only one of the costs

Budget separately for the whole transaction, in cash:

  • Stamp duty (above);
  • Legal fees for conveyancing, which scale with the purchase price;
  • Land search and registration fees;
  • Valuation costs, including the government valuation for duty purposes;
  • Land rates and rent clearance — arrears attach to the property, so establish what is owed before you commit;
  • Agent's commission, where one is involved.

Ask your advocate for a written estimate of the total early. A transfer that stalls because the buyer cannot fund the duty and fees is common and entirely predictable.

The searches that matter more than the price

Before any money moves, have your own advocate — not the seller's — confirm:

  1. Who is the registered owner, and that they match the person selling;
  2. What is registered against the title — charges, cautions, caveats or restrictions;
  3. The land rates and rent position, since arrears follow the property;
  4. Any consents required for the transfer to proceed;
  5. That the property is what the documents say it is — boundaries and use.

Never pay the seller directly. Funds should move through your advocate against agreed milestones — that single rule defeats most property fraud.
