Is Forex Trading Legal in Kenya? (2026)
Is forex trading legal in Kenya? (2026)
Short answer: Yes — and unlike most African markets, Kenya actually licenses online forex brokers locally. The Capital Markets Authority (CMA) has regulated online forex trading since 2017, so you can trade through a broker that answers to a Kenyan regulator. That changes what "safe" looks like here.
Who regulates forex in Kenya?
- The Capital Markets Authority (CMA) licenses online forex brokers and money managers under the Capital Markets (Online Foreign Exchange Trading) Regulations, 2017. Licensed firms are listed on the CMA's public register at licensees.cma.or.ke — see our guide to the CMA-licensed forex brokers in Kenya for the full list and how to check it.
- The Central Bank of Kenya (CBK) oversees the interbank FX market and licenses forex bureaus (changing physical cash) — a different activity from online trading.
Licensed vs offshore brokers — the choice that matters
You'll meet two kinds of broker in Kenya:
- CMA-licensed brokers operate under Kenyan rules: local oversight, a regulator you can complain to in Kenya, and shilling/M-Pesa funding built in. We keep the current list — and how to check any name against the register in two minutes — in CMA-licensed forex brokers in Kenya.
- Offshore brokers (regulated by the FCA, CySEC, ASIC, FSCA and others) also accept Kenyan clients. Trading through them isn't a crime, but your protection sits with a foreign regulator — and often with the broker's offshore entity (Belize, Seychelles), not the tier-1 licence in the adverts. If something goes wrong, the CMA cannot help you.
Given a real local register exists, our view is simple: check the CMA list first. It's the one advantage Kenyan traders have that most markets don't.
Before you fund any account
- Confirm the licence on the regulator's own register — CMA for local brokers, the foreign register for offshore ones. Never rely on a screenshot in the broker's marketing.
- Confirm which legal entity you're onboarded under.
- Beware "trade for you" schemes. Guaranteed-return forex "investments" are a recurring Kenyan scam pattern the CMA has warned about repeatedly. Only CMA-licensed money managers may manage forex funds for clients — and even they cannot guarantee returns.
Risk warning: forex and CFD trading is high-risk and most retail traders lose money. Trade only money you can afford to lose.
Frequently asked questions
Do I pay tax on forex profits in Kenya? Trading profits are generally treated as taxable income by the KRA — keep records and ask a tax professional about your situation.
Can I fund a forex account with M-Pesa? CMA-licensed brokers support local funding including M-Pesa; offshore brokers vary. See our guide to funding a forex account with M-Pesa.
Is forex trading the same as forex bureaus? No — bureaus exchange physical currency under CBK rules; online trading is speculation on price movements under CMA rules.
